Job Description
To efficiently and effectively provide commercial support to the business, implementing commercial processes and systems from conception to final account, reporting to Head of Legal.
Responsibilities
Carry out commercial review and risk analysis of contracts at all stages of a project
Provide commercial links between Site Agents, Project Managers and Directors
Provide commercial links within the Estimating Department
Prepare and/or the management of contractual claims
Control, monitor and manage external commercial consultants such as legal and technical advisers
Resolve contractual issues or disputes, including claims, litigation, arbitration and adjudication, as required
Develop and maintain awareness of Health and Safety and other relevant regulations to inform decision making
Review subcontracts and provide operational advice
Amend standard form contracts and draft or review bespoke contracts
Undertake any other duties as reasonably required including travel as necessary
Key Relationships:
Departmental relationships within the Company including site agents, Contracts Managers, and Directors
Inter-departmental relationships within the company including accountants, credit control and administration
Customer contact regarding contractual issues
Contact with relevant bodies, consultants, advisers and experts in dispute resolution and arbitration.
Main Challenges:
Effectively carrying out a varied managerial role
Managing competing priorities in a demanding environment
Developing and building internal and external relationships
Understanding commercial and legal aspects of contracts
Taking responsibility for own work areas
Requirements
Minimum of 10 years commercial management gained within the civil engineering profession.
Experience or qualification in contract law (including working with and negotiating contracts)
Excellent and proven analytical and commercial ability
Strong working knowledge of Standard Forms of contracts mainly NEC, JCT and FIDIC
Strong interpersonal and communication skills. Ability to communicate to a high standard, both written and verbally
Strong IT skills
Capable of meeting deadlines/timelines in a timely manner
Team player willing to help out colleagues and able to build relationships.
